Terms of Use

The short version: Daily Captain is a daily goal sheet. What you write is yours, and we never read it. Some of it you can choose to publish, on a profile page of your own that is on by default, or send to an accountability buddy; that part is on you, and we can take down anything published that should not be. Right now it is an invitation-only preview: we decide who gets in, there is no charge, and we can end access at any time. It is early software made by a small company, so do not treat it as the only place your data lives. If we ever start charging, you will see and accept new terms before anything is charged. Be decent, and we will be too.

1. The agreement

These terms are between you and Heegstra LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA ("we", "us"), and they apply when you use Daily Captain at dailycaptain.app, at goals.heegstra.io, or installed on your device.

You create your account by signing in for the first time, and by doing that you accept these terms and our Privacy Notice. If you do not accept them, do not sign in.

The Privacy Notice is part of this agreement. It explains what we collect, why, and who else sees it, and signing in means you agree to us handling your data that way to run the service for you. It is linked from the sign-in screen and from Settings, and it is worth two minutes of your time.

2. Who can use it

You must be 16 or older. If you are under 18, you may use Daily Captain only with the agreement of a parent or guardian, who accepts these terms with you.

One account per person. You may not use Daily Captain on behalf of anyone else or resell access to it.

3. What Daily Captain is

A daily sheet: goals in the morning, a check at midday, an honest count in the evening, with one quote a day and optional reminders. Around it, a year and a week to plan against, a profile page of your own that anyone can read, an accountability buddy you can send a week to, and a community quote you can submit for everyone's sheet.

It is a tool for your own use. It is not medical, psychological, therapeutic, financial or professional advice, it is not a treatment for anything, and it is not a substitute for talking to a professional. Nothing in the app, including the daily quote, is advice about your life. What you decide to do with your day is your decision and your responsibility.

4. Invitation and access

Daily Captain is an invitation-only preview. We decide who receives an invitation and when, one person at a time, and we may decline an invitation or end someone's access without giving a reason. Access is personal to you: do not share it and do not pass your invitation on.

An invitation is not an account. It only means the sign-in screen will work for your email address. You create the account yourself, by signing in, and at that moment you accept these terms and the Privacy Notice. Until you do, we hold nothing about you except the invitation itself.

There is no charge. We do not sell access today, nothing in the app takes payment, and nothing you do here obliges you to pay us or obliges us to keep the service free.

If we start charging, we will publish new terms setting out the price and what it buys, and you will see and accept them before anything is charged. Nothing in this document fixes a future price, promises anyone free access later, or entitles anyone to a particular feature.

Subscribing to our newsletter, which lives on heegstra.io and is where the sign-in screen sends you, is not a purchase, does not reserve a place, and creates no account or entitlement. If we agree something separate with you before public launch, that agreement will be in writing between us and sits alongside these terms.

5. It is a preview

Daily Captain is early software. It may be incomplete, may change without warning, may be unavailable, and may contain bugs that lose data. Do not use it as the only record of anything you cannot afford to lose, and keep your own copy of anything that matters. We may change how the product works, reset test data, or end the preview, and we will tell you in the app or by email before we do anything that would delete your sheets.

6. Our content

Daily Captain, its software, design, text and branding belong to us or to our licensors. We give you a personal, non-transferable, non-exclusive right to use the app as it is intended to be used, for as long as your account is open. You may not copy, resell, reverse-engineer or build a competing service out of it.

The daily quotes are quoted for reference and remain the work of the people who said or wrote them; where we know the source, we name it.

If we approve a quote you submitted, it goes out on everybody's sheet for a day with your name on it. You keep every right in what you wrote; you give us permission to publish it that way, and to keep publishing it on the day it was given. Ask us and we will change the name on it or take it down.

7. Your content

Everything you write is yours. You keep every right in it. What changes from one part of the app to the next is who else gets to see it, so this section is in four parts.

What you keep to yourself. Your daily sheets, your evening notes, your Dream Year while its switch is off, and everything else that is not covered below. You give us only the permission we need to run the service for you: to store it, to show it back to you, and to sync it between your devices. That permission ends when you delete the content or your account. We do not read it, publish it, share it, or use it to train any AI model. If we ever build an AI feature that would send your content to a model, it will be off unless you switch it on.

What you publish. Your profile page is public, and it is on by default. While it is on, anyone with its address can read it and search engines are asked to index it. By putting something there you ask us to publish it, and you give us permission to store it, to render it on that page and to let it be shared and previewed while the switch is on. Switch it off and we stop, at once. But publishing cannot be fully undone: a search engine's cache, a preview a chat app kept, or somebody's screenshot are outside our reach and outside yours. Publish accordingly.

What you send to a buddy. When you send a week, you give us permission to deliver a frozen copy of it to the person you chose, and you give that person permission to keep and read it. Unlinking does not take a delivered week back. Deleting your account does: it removes the weeks you sent from their inbox. Their reply is theirs on the same terms.

What you send us for the community. A quote submission asks us to consider publishing it; section 6 says what happens then.

You are responsible for everything you write, publish or send, and for having the right to publish it. Do not put anything unlawful there.

Feedback is different.

If you send us feedback, ideas or bug reports, we may use them freely to improve Daily Captain, with no obligation and no payment to you. You are not giving away rights in your sheet; only in the suggestion you chose to send us. Do not send us confidential information in feedback.

8. Fair use

Do not use Daily Captain to break the law, to attack or overload the service, to access anyone else's account, or to store unlawful content. Do not try to get around the invitation gate, the payment gate, the rate limits or the bot check, and do not scrape or automate access to the app.

Because parts of Daily Captain are seen by other people, a few more:

  • Do not publish anything unlawful, hateful, sexual, threatening, or that impersonates somebody else, on your profile page, in your photo or in a quote you submit.
  • Do not publish other people's private information, or a photo of someone who has not agreed to it.
  • Do not use an invitation link to walk strangers past the invitation gate, and do not sell or trade invitations.
  • Do not use a buddy reply, a quote or a profile field to harass, abuse or advertise to anyone.
  • Do not publish a page or a photo for anyone under 16.

We do not read what you put on your own page before it goes up: it passes an automatic check and nothing more, and nobody looks at a photo before it is published. A quote you submit to the community is the exception: a person reads every one of those before it goes anywhere. Either way, the rules above are yours to keep, not ours to enforce in advance.

9. Availability and changes to the product

We aim to keep Daily Captain available and your data safe, and we take backups. We do not promise uninterrupted service.

We may change, add or remove features. If a change materially reduces what you paid for, we will tell you in the app or by email before it takes effect. If we ever stop offering Daily Captain, we will give at least 30 days' notice and a way to get your data out first.

10. Taking things down, suspension, and ending the agreement

Taking things down. We may remove or hide anything published through Daily Captain, whether a profile page, a photo, a handle, a Cookie Jar line or a published quote, if we believe it breaks section 8 or the law, or if someone tells us it does and they are right. We will say why where we can, and you can reply and ask us to put it back. We do not promise to catch anything in advance; what we promise is to act once we know.

Reporting something. If you see something on Daily Captain that should not be there, email hello@dailycaptain.app with the address of the page and what is wrong with it. If it concerns you personally, for instance your photo, your name, or your private information sitting on somebody else's page, say so and we will treat it as urgent.

Suspension. We may suspend or close an account that breaks section 8, or that we are legally required to close. Except where the law or an active attack makes that impossible, we will tell you why first and give you a chance to put it right. The preview costs you nothing, so closing an account costs you nothing.

Ending it yourself. You may stop at any time and delete your account from Settings; deletion becomes final after 30 days, as described in the Privacy Notice. Deleting takes your page and photo down at once, removes any published quote of yours, and removes the weeks you sent from your buddies' inboxes. It cannot reach copies that have already left us, such as a search engine's cache, a stored link preview or a screenshot, and unlinking from a buddy does not take back a week they were already sent.

11. Your account, and the emails we send

You sign in with a link or a six-digit code sent to your email address; there is no password. Anyone who can read your email can get into your account, so keep your inbox secure. Tell us at hello@dailycaptain.app if you think someone else has used your account.

What we email you. Two kinds, and nothing else. First, what running your account requires: your sign-in links and codes, security notices, and the occasional message this agreement obliges us to send, meaning a change to these terms, a change that would delete your sheets, or the end of the service. Second, what the features you use produce: a message when a buddy sends you their week, and a message telling you what we decided about a quote you submitted. Every account gets both from the day it is created.

These are part of the service rather than something to subscribe to, so there is no unsubscribe link on any of them. The account emails stop when you delete your account. The feature emails stop when you stop using the feature: unlink the buddy, or submit no more quotes.

A feature email never carries your sheet. It tells you something is waiting and links you to the app, where you sign in to read it. That is what keeps section 7 true: deleting your account can reach a week sitting in your buddy's inbox in the app, and it could never reach one sitting in their mailbox.

We do not send you marketing. The one exception is our newsletter, which is not part of your account: you only get it if you ask for it, by ticking the box when you set up your profile or by signing up on heegstra.io, and only after you confirm by clicking the link Kit emails you. Every newsletter carries a one-click unsubscribe, and leaving it changes nothing about your account. We will not put promotional content into any of the emails above to get around this.

12. If we ever start charging

We take no payments today. There is nothing to pay, nothing to refund, and no subscription to cancel.

When that changes, a new version of these terms will set out the price, what it buys, how refunds work, and, for consumers in the EU and the UK, the statutory 14-day right of withdrawal for digital content and how it is waived in exchange for immediate access. You will see and accept those terms before anything is charged. Until then, no part of this document asks you for money.

13. Disclaimers and liability

Daily Captain is provided as is and as available. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, for lost profits, or for loss of data beyond restoring what we hold in backup. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

None of this limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, and, importantly, your mandatory rights as a consumer where you live. If you are a consumer in the EEA or the UK, your statutory rights against us are unaffected by anything in this section.

14. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, and the courts of Wyoming have jurisdiction, except that if you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring proceedings in your own local courts.

Before going to court, email us at hello@dailycaptain.app. Almost everything gets solved that way, and we will answer.

15. Changes to these terms

We may update these terms. We update the version and the date at the top, and we tell you in the app or by email before material changes take effect. Continuing to use Daily Captain after that means you accept the new terms; if you do not, you may delete your account, and if you had paid within the previous 14 days we will refund you.

16. General

If any part of these terms is found unenforceable, the rest stays in force. Not enforcing something once does not mean we give up the right to enforce it later. You may not transfer this agreement; we may transfer it to a successor that takes on Daily Captain, on the same terms. These terms and the Privacy Notice are the whole agreement between us about Daily Captain.

Changelog

  • 2.2, 30 Aug 2026: section 11 stops saying we email you "only what running your account requires", which stopped being true when features started emailing you. It now names two kinds of email and says every account gets both: what the account needs, and what a feature you use produces, meaning a buddy sending you their week and our decision on a quote you submitted. Neither kind carries an unsubscribe, and the section now names the real off-switch for each rather than pointing at account deletion for all of them: delete the account for the first kind, unlink or stop submitting for the second. New with it, the promise that a feature email never carries your sheet and only links to it, which is what keeps section 7's deletion promise honest: we can take a week out of an inbox in the app and we could never take one out of a mailbox.
  • 2.1, 29 Aug 2026 (draft): section 11 now says which emails your account brings with it (sign-in, security, and the notices sections 5, 9 and 15 already promise), that they carry no unsubscribe because they are the service rather than a subscription, and that we send no marketing except the newsletter you asked for, including a promise not to slip promotion into a service email, which is the line that keeps the two apart. Otherwise rewritten for the 29 August release, which is the first one where other people see what a user writes. Section 3 describes the product as it now is. Section 6 covers a community quote published under your name. Section 7 is split into four: what you keep private (the old absolute promise, intact), what you publish on your own page (which is on by default, indexable, and cannot be fully unpublished), what you send to a buddy (a frozen copy they keep after you unlink, gone when you delete your account), and what you submit to the community. Section 8 gains the rules a public page needs and says plainly that we do not pre-screen. Section 10 becomes takedown, reporting and suspension: we may remove what is published, here is where to report it, and here is what deletion and unlinking actually reach.
  • 2.0, 28 Aug 2026 (draft): rewritten in Jan's Cowork legal review. Section 4 now describes the invitation-only preview and no price at all: no $20, no "lifetime", no free-for-good promise, because none of that is true yet and a price commitment made now would bind us later. Payment terms move to a version bump you accept before anything is charged. Liability floor raised to US$100 so the cap means something while the product is free.
