Giveaway Terms

The short version: Enter for free, one entry per person, and one of you wins US$50. To enter you need a Daily Captain account, your public page switched on with at least one yearly goal on it, and an Instagram story that shares that page and tags @jan_sytze. Then press the button on dailycaptain.app/giveaway while signed in and give us your Instagram handle. Entries close at 300, or on 31 December 2026, whichever comes first, and we publish the result within 24 hours of closing. The draw is random, done by a method anyone can check. We cannot see your story, so we check it by hand for the winner only, before we pay, and we may ask the winner for a screenshot from their Instagram Archive. You must be 18 or over. Nothing about the giveaway is run, sponsored or endorsed by Instagram or Meta.

1. Who is running this, and what these terms are

This giveaway is run by Heegstra LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA ("we", "us"), the company behind Daily Captain. Contact for anything about it: hello@dailycaptain.app.

Pressing the "Participate" button on dailycaptain.app/giveaway is your agreement to these terms. They sit alongside the Daily Captain Terms of Use and Privacy Notice, which continue to apply to your account. Where these terms say something specific about the giveaway, these terms govern the giveaway; for everything else about your account, the Terms of Use govern. Nothing here reduces a right the Terms of Use or the law already gives you.

The giveaway is not sponsored, endorsed, administered by, or associated with Instagram, Meta, Apple or Google. You are giving your information to us, not to them.

2. Who can enter

You can enter if all of the following are true:

One entry per person, and one per account. The app refuses a second entry from the same account. It cannot stop a person creating a second account with a second email address, so that is a rule rather than a lock: the Terms of Use already say one account per person, and a duplicate entry is removed under section 9, before or after the draw.

Entering is free. You do not have to buy anything, subscribe, or pay to enter or to win. A Daily Captain account can be created without paying anything: a new account gets 8 days free, and you can enter, and win, inside those days.

3. How to enter

In order:

  1. Have a Daily Captain account at dailycaptain.app. Create one by signing in for the first time, if you have not already.
  2. Write at least one yearly goal for the current year, on the Year screen. Your yearly goals appear on your public profile page while their switch is on. The app will not accept an entry without at least one yearly goal, because otherwise there is nothing on the page to share.
  3. Have your public profile page switched on. It is on by default; the switch is on the Profile screen. The app will not accept an entry while it is off. It must still be on at the moment of the draw: if it is off then, the page you shared no longer exists and the entry cannot be checked, so it is not a valid entry. The switch stays yours at all times. Turning your page off is always your right; it just takes you out of the giveaway.
  4. Share your public profile page on your Instagram story and tag @jan_sytze in that story. Sharing means a story that shows or links to your page at dailycaptain.app/your-handle. The story has to be posted from the Instagram account whose handle you give in step 5. You are responsible for following Instagram's own rules for that story.
  5. Go to dailycaptain.app/giveaway while signed in, type your Instagram handle, and press "Participate". That is the entry, and that press is your agreement to these terms. The page then shows you your entry code, which you can use to check the draw (section 7).

We cannot see your story. We have no access to Instagram, and we do not ask for anything at entry. Step 4 is checked by a person, and only for the entry that is drawn, before the prize is paid. A story lasts 24 hours and it does not have to still be up at the draw. We reserve the right to ask the drawn entrant for proof that the story was posted, and Instagram keeps that proof for you: your own stories stay in your Archive (Profile > Menu > Archive) after they expire, and a screenshot of the archived story showing your page and the @jan_sytze tag is all we need. An entrant who cannot show the story when asked is disqualified and we draw again. So someone who presses the button without posting is in the draw, and is out if drawn.

We do not look at your daily sheets, your goals or anything else you wrote to decide whether you have entered. Steps 2 and 3 are checked by the app at the moment you press the button, from the state of your account, and that is the only checking the app does.

4. When it closes

Entries close at whichever of these comes first:

A confirmed entry is a press of the "Participate" button that the app accepted and that has not been withdrawn. The giveaway page shows the current count. A withdrawn entry frees its place, so the count can go down as well as up until it closes.

If the 300th entry never comes, the draw is made from everyone validly entered at the closing time on 31 December 2026. There is no minimum number of entries: if there is one valid entry, that person wins.

5. The prize

One prize: US$50, to one winner. It is cash, so there is nothing to substitute, and it cannot be transferred to somebody else.

How we pay. We agree the payment channel with the winner when they claim, from what is available to both of us at that moment: PayPal, Wise, Veem, a Mercury payment link, or similar. The winner may have to give that service the details it needs, and any fee or exchange-rate cost charged by the winner's own service or bank is the winner's. The app itself stores nothing about the payment: no bank detail, no payment address, no upload. The claim happens by email or Instagram direct message, between the winner and us, and that is where your payment details go and the only place they go.

Tax. US$50 is paid as US$50. Any tax due on a prize where you live is yours to deal with, and we do not give tax advice.

6. The winner: draw, announcement, claim

We publish the result within 24 hours of closing, on dailycaptain.app/giveaway and on @jan_sytze on Instagram.

We contact the winner directly, by email to the address on their Daily Captain account, from hello@dailycaptain.app, or by Instagram direct message to the handle they gave at entry, or both. That message says how to claim.

The winner has 14 days from that message to claim. Claiming means replying, by email or Instagram direct message, and agreeing a payment channel with us. Before we pay, a person at Heegstra checks by hand that steps 3 and 4 of section 3 were met: the public page is on, and the story with the tag was posted from the account whose handle was given, using what is visible on Instagram and, if we ask for it, the proof from your Instagram Archive described in section 3.

If the winner does not claim within 14 days, or does not meet these terms, that entry is out and we draw again from the remaining valid entries, by the same method, and announce the new result the same way. That repeats until a winner claims and is paid, or no valid entries are left.

Naming the winner. We publish the winner's Instagram handle and a link to their Daily Captain public profile page only if the winner agrees to it when claiming; one agreement covers both. Until then, and if the winner would rather not be named, the announcement says only that the prize has been claimed, or is being claimed. Never the winner's email address, and never their name from their profile beyond what the public page itself shows. Not being named does not affect the prize.

7. How the draw works

The draw is random, and it is done in a way that anyone can check rather than take on trust.

  1. At closing, the list of valid entries is frozen, in the order the entries were made.
  2. Each entry has an entry code, shown to you on the giveaway page when you enter. It is derived from your entry's internal record in a way that cannot be reversed into your account or your handle. We publish the frozen list as numbered entry codes, not as handles or names, so you can find your own number and nobody else can find you.
  3. Before running the draw, we publish a random seed on the giveaway page and on @jan_sytze. The seed is chosen and posted before the draw is run, and the draw refuses to run without a published seed.
  4. The winning number is derived from the published seed and the published list by a fixed calculation, which is described with the result, so that anyone with the seed and the list can arrive at the same number. The script that does it only reads the entry list; it changes nothing.
  5. We publish the seed, the list, the calculation and the result together, so the announcement is the audit.

A redraw under section 6 or 9 uses the same list with the removed entries taken out, and a new published seed.

8. Withdrawing

You can take your entry back at any time while the giveaway is open, with one press on the giveaway page. That removes your entry from the draw and frees the place. Deleting your Daily Captain account also removes your entry, because the entry is part of the account, so an account deleted before the draw is out of the draw. Turning your public page off does not withdraw the entry, but it makes the entry invalid at the draw (section 3, step 3).

9. Entries we remove

We may remove an entry, before or after the draw, where:

What we can see is what the app records, which is the account, the moment of entry, and the state of the public page and the yearly goals, and what is publicly visible on Instagram. Anything on Instagram grounds is our judgement from what a person can see publicly, and we will tell you why if we remove your entry. Where an entry is removed after the draw, we draw again under section 7.

10. Instagram, and what you agree to

Instagram and Meta are not sponsors of this giveaway, are not associated with it, and do not administer or endorse it. By entering, you release Instagram and Meta from any responsibility for it. Your story is subject to Instagram's own terms, and it is yours: posting it does not give us any right in it.

To the extent the law allows, you release Heegstra LLC from claims arising out of taking part in this giveaway or accepting the prize. That release sits inside section 13 of the Terms of Use, not on top of it: it does not limit liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, and your mandatory rights as a consumer where you live. If you are a consumer in the EEA or the UK, your statutory rights against us are unaffected by anything in these terms.

11. Your data

Entering creates one small record on your account: that it entered, when, the Instagram handle you typed, the version of these terms you agreed to, and, if you withdraw, when. We use it to run the giveaway, to make and publish the draw, to contact and pay the winner, and to show, if anyone questions it, who entered on what terms. The legal basis is the contract you make by entering, and, for publishing the winner's handle and profile link, the agreement the winner gives when claiming.

We use the Instagram handle you give us for nothing else. It is not added to your profile, not published, not used to contact you for anything other than this giveaway, and not passed to anyone. The only people who see it are us, and, on the day, the person checking the winner's story.

What we do not collect for this: no screenshot at entry, no date of birth, no follower count, no IP address, and nothing about how the prize is paid. The one exception is the proof of the story we may ask the drawn entrant for (section 3): if we ask for it and you send it, it is kept with the winner's record and nowhere else.

How long. Giveaway entries are deleted 12 months after the draw. The winner's entry is kept with the record of the payment, for as long as that record is kept. Your entry is included in the copy of your data you can take from Settings > Privacy > Export my data, and deleting your account deletes it with everything else, as the Privacy Notice describes.

Everything else about how we handle your data, including your rights and how to use them, is in the Privacy Notice, which applies to the giveaway as it applies to the rest of Daily Captain.

12. If something goes wrong

We may end the giveaway early, or change these terms, only where something outside our control makes it impossible to run as described: fraud or automated entries on a scale that breaks the count, Instagram or Daily Captain being unavailable, or a legal reason. If that happens after any valid entries exist, we still draw a winner from the valid entries made up to that moment, by the method in section 7, and pay the prize. We do not end the giveaway because it is going badly for us, and we do not change these terms to somebody's disadvantage after they have entered. Any change is published on the giveaway page with the new version number, and an entry stays under the version it was made on.

13. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, and the courts of Wyoming have jurisdiction, except that if you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring proceedings in your own local courts.

14. General

If any part of these terms is found unenforceable, the rest stays in force. Not enforcing something once does not mean we give up the right to enforce it later. Where these terms and the Terms of Use both speak to the same point about the giveaway, these terms apply to the giveaway; the Terms of Use apply to everything else about your account.
